Users are either Member Users or Non-Member Users.<br \/><b>Member User : <\/b>a user who has subscribed to MY WATER MANAGER on its Website and can create profiles and authorisations for non-member Users. The member User is the one who has, within the installation, the roles of resident Administrator or non-resident Administrator.<br \/><b>Non-member User : <\/b>a user who has not taken out a subscription on the Website and who does not have the rights and authorisations offered to member Users. The non-member User is the one who has, within the installation, the roles of Operator or Occupant or User or Child or Restricted or Blocked.<br \/><b>Services : <\/b>refers to the various services offered to different types of Users (members and non-members) by MY WATER MANAGER on the Website and the Application.<br \/><b>Reserved Services : <\/b>refers to Services reserved for User Members who have taken out a subscription with MY WATER MANAGER on its Website.<br \/><b>Personal data :<\/b> means any data relating to an identified or identifiable natural person.<br \/><b>Subscription :<\/b> subscription taken out with MY WATER MANAGER on its Website in order to benefit from the reserved Services.<br \/><b>Customer account :<\/b> personal account accessible on the Customer Platform and the Application and enabling access to the Services.<br \/><b>Module : <\/b>Connected device installed on the User\u2019s pipes enabling MY WATER MANAGER to take measurements in order to provide its services.<br \/><b>Box : <\/b>Device installed on the User\u2019s premises that enables communication with MY WATER MANAGER\u2019s infrastructure.<br \/><b>Installation :<\/b> refers to all the hardware made available to Users by MY WATER MANAGER (Modules and Boxes).<br \/><b>Installer :<\/b> refers to the person authorised to create an Installation under the conditions defined in article 7.1 of the GCU.<\/p><div><b>Zone : <\/b>refers to a specific water area equipped with a set of MY WATER MANAGER modules (bathroom, kitchen, etc.), which may include several water points (washbasin, sink, shower, toilet, etc.).<\/div><div>\u00a0<\/div><p>\u00a0<\/p><h4><u>\u2022 <b>A<\/b><b><\/b><b>rticle 3\u00a0: Preamble and opposability<\/b><\/u><\/h4><p>\u00a0<\/p><p>The purpose of these GCU is to provide a legal framework for the provision and use by the User of the Application and the Website as well as the Services offered by MY WATER MANAGER.<br \/>These Terms and Conditions are available on the Site and the Application under the heading \u00abTerms and Conditions\u00bb.<br \/>Any use of the Site or the Application implies the User\u2019s unreserved and unrestricted acceptance of these GCU. When the User registers on the Customer Platform or creates an account on the Application, the User is invited to expressly accept these GCU by ticking the box before the following text: \u00abI acknowledge that I have read and understood the GCU and I accept them\u00bb.<br \/>If the User does not accept the GCU, he or she will not be able to access the Services offered on the Site and the Application.<\/p><div>MY WATER MANAGER reserves the right to unilaterally modify the content of these GCU at any time.<\/div><div>\u00a0<\/div><p>\u00a0<\/p><h4><u><b>\u2022 Article 4 : General presentation<br \/><\/b><\/u><\/h4><p>\u00a0<\/p><p>MY WATER MANAGER\u2019s mission is to prevent water wastage and water damage by enabling consumers to monitor consumption and detect leaks throughout the installation.<br \/>To this end, MY WATER MANAGER offers an innovative and eco-responsible solution for remote control and management of all sanitary installation equipment via the Application.<br \/>The operating principle is based on several autonomous communicating modules interconnected at strategic points in the sanitary installation.<br \/>These modules measure flow rate and incorporate a solenoid valve. They enable the sanitary installation to be divided into several zones, each of which is controlled independently.<br \/>MY WATER MANAGER enables Users to use the Application to control the flow of water, detect water leaks and manage their water consumption.<br \/>The MY WATER MANAGER mobile application is completely free of charge and does not contain any built-in purchases.<br \/>The Subscription offered by MY WATER MANAGER can only be taken out online on the MY WATER MANAGER website and constitutes the consideration for the use of the services offered by MY WATER MANAGER and under no circumstances the consideration for the use of the Application and the functions offered therein.<br \/>This Subscription is not linked to the Application but to the management of data, the network and the various functions relating to the products and services marketed by MY WATER MANAGER.<br \/>Most of the Services accessible from the Application are also available on its Internet version (accessible on the MY WATER MANAGER Website), with the exception of certain services exclusive to the Application (see article 8 below).<br \/>However, payments cannot be made directly via the Application.<br \/>The Website, including the Customer Platform, is intended more for the presentation of the Services, the management of the User\u2019s Account and the payment of their Subscription.<\/p><p>\u00a0<\/p><h4><u>\u2022 <b>A<\/b><b><\/b><b>rticle 5 : Access to the Website and the Application<\/b><\/u><\/h4><p>\u00a0<\/p><p><b>5.1 Access to the Website<\/b><br \/>The Website is accessible free of charge from any location to any User with Internet access. All costs incurred by the User in accessing the service (hardware, software, Internet connection, etc.) are at the User\u2019s expense.<br \/>Consultation of the Website does not require any minimum technical configuration. However, in order to enjoy optimal browsing comfort and performance, it is recommended that you use the latest version of the browser concerned.<br \/>Users of the Website undertake to access it using virus-free equipment.<br \/><b>5.2<\/b><b> Access to the Mobile Application<\/b><br \/>Anyone wishing to use the Application must first download it onto their terminal.\u00a0<br \/>The Application can be downloaded free of charge from the Apple Store for the IOS operating system and from the Play Store for the Android operating system.<br \/>\u00a0Downloading the Application requires the following technical configurations:<\/p><div>&#8211; At least Android version 11 or iOS version 12.1<\/div><div>\u00a0<\/div><p>\u00a0<\/p><h4><u><b>\u2022 Article 6 : Prerequisites for access to Reserved Services<br \/><\/b><\/u><\/h4><p>\u00a0<\/p><p><b>6.1 Accuracy of information<\/b><br \/>By agreeing to subscribe to the reserved Services conditional upon taking out a Subscription on the Website, the Member User undertakes to provide only truthful and accurate information about himself or about non-Member Users.<br \/>If incorrect information is provided voluntarily, access to the reserved Services may be interrupted.<\/p><p><b>6.2 Validating registrations and creating an Account<\/b><br \/>To create an Account on the Application, the User must provide the following information :<br \/>\u2022 E-mail address <br \/>\u2022 Name <br \/>\u2022 First name<br \/>\u2022Telephone number<br \/>To create an Account on the Customer Platform, Users are asked to enter their Installation number.<\/p><p>His details will then be retrieved from his Customer Account previously created on the Application and the User will be asked to confirm his identity by selecting the \u00abyes it\u2019s me\u00bb option. Their details will then be used to create an Account on the Customer Platform, once their email address has been verified.<\/p><p>\u00a0<\/p><h4><u><b>\u2022 Article 7 : Cr\u00e9er, rejoindre et utiliser une Installation via l\u2019Application<\/b><\/u><\/h4><p>\u00a0<\/p><p><b>7.1 Creating an Installation<\/b><br \/>In order to guarantee the safety of the Installation and the correct installation of the MY WATER MANAGER modules, the creation of an Installation is strictly reserved for Installers who are plumbing professionals.<br \/>Any creation of an Installation by a person who is not a professional plumber is strictly forbidden.<br \/>In order to verify compliance with this requirement, the creation of an Installer account on the Application implies compliance with the following conditions :<br \/>&#8211; First of all, the installer is asked to certify on his honor that he is a plumbing professional.<br \/>&#8211; The installer is then asked to enter the code reserved for professionals that was given to him by the distributor <br \/>\u00a0\u00a0 from whom he collected the MY WATER MANAGER products (boxes and modules).<br \/>If these conditions are not met, the User will not be authorised to create an Installation.<br \/>Once the Installation has been configured, the Installer no longer has access to it unless he is granted access again by the Administrator, for example for the purpose of replacing an element of the Installation.<br \/>The Installer\u2019s contact details are displayed in the Installation details to enable the User to contact him if necessary.<\/p><p><b>7.2 Joining an Installation<\/b><br \/>7<u>.2.1. Joining a facility that has no members<\/u><br \/>A User can join a Facility by scanning the QR Code of one of the pieces of equipment making up the Facility. If this Installation does not yet have a member, the User will then be assigned the role of resident or non-resident Owner, depending on whether or not they live in the dwelling corresponding to the installation.<br \/>The role of Owner (resident or non-resident) confers on the User the status of User member, as well as a certain number of privileges detailed in point 7.2 below.<br \/>The User member is then invited to create an account on the Customer Platform, or to connect to their account if one already exists. The purpose of this step is to activate the Installation and create an identification link between the Installation and the User.<br \/>7<u>.2.2. Joining a Facility that already has a member(s)<\/u><br \/>A User cannot join a Facility that already has member(s) by scanning the QR Code. The only way to join the Facility is to respond to the invitation sent by a User member already present in the Facility (resident or non-resident Owner) or an Administrator and to download the Application.<br \/>Once the invitation has been accepted, the User may join the Facility via the Application and will be assigned the role of Resident Administrator or Non-Resident Administrator or Operator or Occupier or User or Child or Restricted or Blocked by the User member already present in the Facility (as Resident Owner or Non-Resident Owner).<\/p><p>\u00a0<\/p><p><b>7.3 Roles and privileges for using a Facility<\/b><br \/>The Facilities do not allow several User members to live together.<\/p><p>The User member who has the role of Resident or Non-Resident Owner on an Installation must carefully assign the roles he wishes to the Users who wish to join the Installation.
